Kelley Drye is pleased to attach the third issue of our State Political Law Compliance Quarterly newsletter. Like previous issues, this newsletter provides updates on a range of state-level lobbying and campaign finance issues. Even as state legislative activities wane as the year moves on and many legislative sessions expire, important changes can still surface in the states. Such changes can impact the way your company or association complies with state political laws. Kelley Drye has developed the newsletter in connection with MultiState Associates Inc.

The attached newsletter highlights more generally the growing intersections between political law and state regulation of business activities. In particular, it describes the application of political law ethics rules to activities of investment professionals, as well as those of pharmaceutical, medical device, and biologic companies. This quarterly newsletter also features law updates coming out of Illinois, North Carolina, New Mexico, and several other jurisdictions.

June, 2009 - State Political Law Compliance Quarterly Newsletter (Q2 2009)

Ensuring that your company or association is in compliance with the full range of state-level lobbying and campaign finance rules and regulations requires ongoing attention. Legislative sessions in many states can be extremely long and regulatory changes can happen at any time. In 2009 alone, hundreds of pieces of legislation have been introduced at the state-level. To help navigate these requirements and stay up-to-date with ever changing ethics requirements, Kelley Drye is pleased to attach the second issue of our State Political Law Compliance Quarterly newsletter. Kelley Drye has developed the newsletter in connection with MultiState Associates Inc. For example, you might not be aware that: * In the 2009 state legislative sessions, at least nine states have introduced or are otherwise considering rules related to pay-to-play; * In Illinois, as a result of the scandals surrounding former Governor Rod Blagojevich, a state panel has unveiled a series of ethical reforms for the consideration of state lawmakers – many of which focus on campaign finance issues; * In New Jersey, state Assembly members are seeking to expand pay-to-play laws in advance of receiving expected federal stimulus funds; * While most states are facing dual challenges of fiscal constraints and expanding citizen needs, the issue of ethics has still managed to receive attention in many places. Among the states with new laws enacted or taking effect this year are: Arizona, Arkansas, California, Iowa, Maine, Michigan, Ohio, Oregon, Utah, and Wyoming. To help avoid these and other compliance challenges, you might be interested in the new online subscription service offering that Kelley Drye is assisting MultiState Associates Inc., to launch: the "State Compliance Guide: Lobbying, Campaign Finance and PAC Contribution Law Summaries." The service is a one-stop, online resource, providing summary information on lobbying and campaign finance laws and regulations in all fifty states and the District of Columbia. Featuring two separate databases, one addressing lobbying rules and the other containing information regarding campaign finance rules, users have the option of purchasing access to either or both databases, both of which are easily navigated by state. Both databases will be updated in a timely manner as lobbying and campaign finance laws continue to evolve, including relevant statutory and regulatory changes. As part of the service, users will receive a subscription to State Political Law Compliance Quarterly as well. Dear Clients and Contacts: In an effort to help ensure that you remain up-to-date regarding Honest Leadership and Open Government Act of 2007 ("HLOGA") issues, Kelley Drye’s Campaign Finance and Political Law Practice Group has prepared the attached Client Advisory. Dear Clients and Friends, The Clerk of the House of Representatives and Secretary of the Senate recently issued detailed joint guidance for lobbyist compliance with the Lobbying Disclosure Act, as amended by the Honest Leadership and Open Government Act of 2007 ("HLOGA"). The joint House and Senate guidance replaces and suspends earlier individual guidance provided by each House of Congress.
